Terms of Service

Welcome to PolyTalk.

These Terms of Service ("Terms") govern your access to and use of the PolyTalk software, website, applications, APIs, Enterprise services, and related offerings (collectively, the "Services").

By accessing, installing, or using PolyTalk, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. About PolyTalk

PolyTalk is a privacy-first AI platform designed for real-time speech-to-speech translation across conversations, meetings, videos, live audio, and other supported media.

PolyTalk may be available as:

  • PolyTalk Community Edition (Open Source)
  • PolyTalk Enterprise Edition
  • Managed or cloud-hosted services (where offered)

Features and availability may differ depending on the edition you use.

2. Eligibility

You must be legally able to enter into a binding agreement under the laws applicable in your jurisdiction.

If you are using PolyTalk on behalf of an organization, you confirm that you have authority to bind that organization to these Terms.

3. Your Account

Some Services may require creating an account.

You are responsible for:

  • maintaining the confidentiality of your account credentials;
  • all activity under your account;
  • providing accurate information; and
  • notifying us immediately if you believe your account has been compromised.

4. Open Source Community Edition

The Community Edition is licensed under the GNU Affero General Public License (AGPL).

Your rights and obligations regarding the Community Edition are governed by the AGPL in addition to these Terms.

Nothing in these Terms limits your rights granted under the AGPL.

5. Enterprise Services

The Enterprise Edition may include additional features such as:

  • premium AI models;
  • enhanced language support;
  • custom voices;
  • enterprise administration;
  • APIs and integrations;
  • analytics;
  • deployment assistance;
  • priority support;
  • managed infrastructure; and
  • additional security features.

Enterprise Services may be provided as:

  • self-hosted;
  • managed by PolyTalk; or
  • another deployment model agreed in writing.

Additional commercial agreements may apply to Enterprise customers.

6. Permissions Required

Certain PolyTalk features require access to system resources.

Depending on the features you use, PolyTalk may request permission to access:

  • microphone input;
  • speakers or audio output devices;
  • screen sharing;
  • browser tab audio;
  • uploaded audio files;
  • uploaded video files; and 

These permissions are used solely to provide requested functionality.

You remain responsible for obtaining any required consent before recording, translating, or sharing another person's voice or content.

7. Voice, Audio and Translation

PolyTalk processes audio only to provide requested translation, transcription, speech synthesis, and related AI functionality.

Translation quality depends on factors including:

  • audio quality;
  • accents;
  • background noise;
  • supported languages;
  • speech clarity; and
  • AI model capabilities.

PolyTalk does not guarantee that translations, transcripts, or generated speech will always be accurate, complete, or suitable for critical decisions.

Users should independently verify important communications.

8. Self-Hosted Deployments

For self-hosted deployments, you are solely responsible for:

  • servers;
  • infrastructure;
  • backups;
  • network security;
  • software updates;
  • user management;
  • compliance obligations; and
  • protection of your data.

Unless explicitly requested by you for support purposes, PolyTalk does not access your self-hosted environment or communication data.

9. Managed or Cloud Services

Where PolyTalk provides managed or hosted services, we may process data necessary to operate, maintain, secure, and improve those Services in accordance with our Privacy Policy.

Data handling may differ depending on the deployment model selected.

10. Acceptable Use

You agree not to use PolyTalk to:

  • violate any applicable law;
  • infringe intellectual property rights;
  • harass, threaten, abuse, or impersonate others;
  • distribute malware or malicious software;
  • interfere with the operation of the Services;
  • gain unauthorized access to systems;
  • disrupt networks;
  • use the Services for fraudulent or deceptive purposes; or
  • attempt to bypass security measures.

11. Third-Party Services

PolyTalk may integrate with third-party AI providers, speech engines, cloud platforms, APIs, or external services.

Your use of those services may also be governed by their respective terms and privacy policies.

PolyTalk is not responsible for the availability, accuracy, or practices of third-party services.

12. Intellectual Property

PolyTalk retains ownership of:

  • the PolyTalk name;
  • trademarks;
  • logos;
  • branding;
  • website content;
  • proprietary Enterprise features; and
  • all intellectual property not licensed under the AGPL.

You may not use PolyTalk trademarks without prior written permission.

13. Privacy

Your use of PolyTalk is also governed by our Privacy Policy.

The Privacy Policy explains how personal information is collected, processed, stored, and protected.

14. AI Limitations

AI-generated translations, transcripts, summaries, and speech synthesis may contain errors.

PolyTalk should not be relied upon as the sole source for situations where incorrect translations could cause harm.

15. Disclaimer of Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis.

To the fullest extent permitted by law, PolyTalk disclaims all warranties, including implied warranties of:

  • merchantability;
  • fitness for a particular purpose;
  • non-infringement; and
  • uninterrupted or error-free operation.

16. Limitation of Liability

To the maximum extent permitted by law, PolyTalk shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including:

  • loss of profits;
  • business interruption;
  • loss of data;
  • loss of goodwill;
  • system failures; or
  • security incidents outside PolyTalk's reasonable control.

Our total liability for any claim shall not exceed the amount paid by you to PolyTalk for the Services during the twelve (12) months preceding the event giving rise to the claim.

If you use the Community Edition without charge, PolyTalk's liability shall be limited to the maximum extent permitted by applicable law.

17. Indemnification

You agree to indemnify and hold harmless PolyTalk, its affiliates, employees, directors, and partners from claims, damages, liabilities, and expenses arising from:

  • your use of the Services;
  • your violation of these Terms;
  • your violation of applicable laws; or
  • your infringement of another person's rights.

18. Suspension and Termination

We may suspend or terminate access to Enterprise Services if you:

  • violate these Terms;
  • misuse the Services;
  • fail to pay applicable fees; or
  • create security risks for PolyTalk or other users.

Termination of Enterprise Services does not affect your rights under the AGPL for the Community Edition.

19. Changes to the Services

PolyTalk may update, improve, modify, or discontinue features at any time.

We may also introduce new features or retire existing functionality where reasonably necessary.

20. Changes to These Terms

We may revise these Terms periodically.

The updated version will be published on our website with a revised "Last Updated" date.

Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

21. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of India.

Any disputes shall be subject to the exclusive jurisdiction of the competent courts located in Ahmedabad, Gujarat, India, unless otherwise required by applicable law.

22. International Use

You are responsible for ensuring that your use of PolyTalk complies with all applicable local laws, regulations, export controls, and data protection requirements in your jurisdiction.
